1. Data controller

LegalBytes SAS, with registered address at Calle 78B # 116B-50, Bogotá D.C., Colombia ("LegalBytes", "we", "us"), is responsible for the processing of personal data collected through this website and our contact channels.

2. Legal framework

This policy is governed by Article 15 of the Political Constitution of Colombia, Statutory Law 1581 of 2012 on personal data protection, Decree 1377 of 2013 (compiled in Decree 1074 of 2015), and any other rules that amend or regulate them.

3. Data we collect

When you use the contact form or request a review, we collect: your name, email address, company (optional), the service you are interested in, and the message you write.

When you browse the website, we may receive basic technical data, such as IP address, browser type and pages visited, which is needed for the site to work and stay secure.

If you use the WhatsApp demo, we collect your mobile phone number and the messages you send to, and receive from, the demo number.

We do not request sensitive data (such as health, racial or ethnic origin, sexual orientation, political or religious beliefs, or biometric data). Please do not include it in your messages. If you do, we will process it with the safeguards set out in Article 6 of Law 1581, or delete it.

4. Purposes of processing

Your data is used to: respond to your request; schedule and prepare a review or consultation; send communications related to that request; manage pre-contractual or contractual relations; improve the security and operation of the website; and comply with legal obligations.

We will not use your data to send advertising or newsletters without a separate authorization, which you can give or refuse at any time.

We use your phone number and messages to operate the WhatsApp demo, after you have opted in, and to confirm your access to it.

Job applications: if you apply for a role, we use your name, contact details, CV or portfolio, and any other information you send, to assess your application. Only the people involved in the selection can access it. We delete it when the selection process ends, unless you authorize us in writing to keep it for future roles.

5. Authorization

By ticking the authorization box on the contact form, you give LegalBytes prior, express and informed authorization to process your data as described in this policy. You may revoke your authorization at any time, as explained in section 8.

6. Processors and transfers

Some providers process data on behalf of LegalBytes, for example our email sending service and website hosting. These providers may only use the data to provide the service to us, and must protect it.

Some of these providers are located outside Colombia, in particular in the United States. Your data may therefore be transferred and stored abroad. LegalBytes requires these providers to give contractual data protection guarantees, in line with Article 26 of Law 1581 of 2012 and SIC instructions.

WhatsApp messages are sent and processed through Meta Platforms, Inc. (WhatsApp Business Platform). Meta may process this data in the United States and other countries outside Colombia, under its own terms and privacy policy.

LegalBytes does not sell personal data.

7. Security

We apply reasonable technical, human and administrative measures to protect your data against unauthorized access, loss or use. No system is completely secure, so we cannot guarantee this absolutely.

8. Your rights as a data subject

Under Article 8 of Law 1581 of 2012, you have the right to:

a) Know, update and correct your personal data held by LegalBytes.

b) Request proof of the authorization you gave.

c) Be informed about how your data has been used.

d) Revoke your authorization and/or request deletion of your data where the principles, rights and guarantees of the law are not respected.

e) File complaints with the Superintendence of Industry and Commerce (SIC) for violations of the law.

f) Access your personal data free of charge.

To exercise these rights, write to contact@legal-bytes.com with the subject "Habeas data", stating your name, a contact method and the specific request. We will answer inquiries within ten (10) business days and claims within fifteen (15) business days, counted from the day after we receive them. If we cannot respond within those periods, we will tell you why and give a new date, within the limits set by law.

9. Data retention

We keep your data for as long as needed to fulfil the purposes described and as the law requires. After that, we delete or anonymize it.

WhatsApp demo data (phone number and message content) is kept for 180 days from your last message, and then deleted or anonymized. You can stop receiving messages at any time by replying STOP, and you can ask us to delete your data sooner by writing to the address in section 8. We record the date and time of your opt-in and of any withdrawal.

10. Cookies and similar technologies

The website only uses the technical cookies needed to operate. We do not use advertising cookies. If we later use analytics or advertising tools, we will update this policy and ask for authorization where required.

11. Minors

The website is aimed at people and companies that buy professional services. We do not intentionally collect data from minors. If we find we have collected a minor's data without their legal representative's authorization, we will delete it.

12. Changes to this policy

We may update this policy. The current version will always be published on this website, with its last-updated date. For substantial changes, we will notify you on the website or by email.
